Questions
How is end of service gratuity calculated in the UAE?
Under Article 51 of Federal Decree-Law No. 33 of 2021, a full-time private-sector employee with at least one year of continuous service gets 21 days of basic wage for each of the first five years and 30 days for each year after that. Part years count pro rata, and the total cannot exceed two years’ wage.
Does resigning reduce my gratuity?
Not under the current law. The old reductions for resignation were removed when Decree-Law No. 33 of 2021 came into force in February 2022, so resignation and termination are worked out the same way.
Is gratuity based on basic salary or total salary?
On the last basic wage. Housing, transport and other allowances are not included.
Why are there two ways to work out the daily wage?
The law does not spell out a daily-wage formula. Most employers and the common calculators divide the monthly basic by 30; some use basic × 12 ÷ 365. The calculator shows both so you can compare. Your contract and the Ministry of Human Resources and Emiratisation (MOHRE) decide the official figure.
Do unpaid leave days count?
No. Days of unpaid absence are not counted as service. Enter them in the calculator and they are taken off.
